Terms of Service

These terms govern your use of the RoamingProxy platform (the “Service”). Section 1 says exactly what the Service currently delivers. By creating an account or using the Service you agree to these terms. If you are agreeing on behalf of a company, you confirm you have authority to bind it.

1. What the Service is

The Service is provided by Trade Vault LLC, a limited liability company, trading as RoamingProxy. In these terms “we”, “us” and “our” mean Trade Vault LLC.

RoamingProxy provides developer infrastructure accessed over HTTP APIs. Three things serve requests today: the HTTPS proxy API, the user-agent library, and the social data API. Proxy egress currently covers three regions, us-east, us-west and europe; call GET /v2/proxy/regions for the live list.

The social data API returns posts and profiles from platforms whose own public APIs answer us: Bluesky, an allowlisted set of Mastodon instances, and Hacker News. It is in beta and currently unpriced — your calls are metered but do not bill. Beta means the surface may change and it carries no delivery commitment; call GET /v2/social/platforms for what is live, including which platforms we deliberately do not cover and why.

The SERP API has been withdrawn and is not part of the Service. It is not sold and it does not return results: search engines serve a JavaScript challenge to datacenter addresses, so there is nothing for our parser to read. This is stated rather than omitted because API keys issued earlier may still carry a serp scope — we have not revoked those keys, but the scope does not entitle you to a product we no longer provide.

Anything not named above is not part of the Service, is not sold, and carries no delivery commitment. We may add or retire features; if we retire something you are actively paying for, we will give you at least 30 days' notice by email.

2. Your account

You must provide an accurate email address and keep your credentials and API keys secret. You are responsible for all activity under your account and API keys, including activity by anyone you share a key with. Tell us promptly at support@roamingproxy.com if you believe a key has been exposed, and rotate it from the dashboard.

You must be at least 18 years old, and you must not be located in, or use the Service on behalf of anyone in, a jurisdiction subject to comprehensive sanctions that would make providing the Service unlawful.

3. Acceptable use

A proxy network can be abused, so this section is enforced strictly. You may not use the Service to:

  • Access any system you are not authorised to access, or bypass authentication, paywalls, rate limits, or access controls you are not entitled to bypass.
  • Send unsolicited bulk messages, conduct credential stuffing or brute-force attacks, distribute malware, or run denial-of-service traffic.
  • Collect personal data in violation of applicable data-protection law, or scrape content in violation of a site's terms where you have been put on notice of them.
  • Target the Service at child sexual abuse material, content that incites violence, or activity that is fraudulent or unlawful in your jurisdiction or ours.
  • Resell raw proxy access as a competing proxy product, or share your account with unrelated third parties.
  • Circumvent usage metering, quotas, or billing, including by operating multiple accounts to obtain repeated trial credit.

We may suspend or terminate access immediately, without refund, for a material breach of this section. Where the breach is not causing ongoing harm we will normally contact you first.

4. Fees, metering and invoicing

Usage is metered per request. The dashboard shows usage recorded against your account; those records are the basis for what you are charged.

Accounts are billed by invoice. Before we charge you anything we will agree pricing with you in writing, and the rates in effect are published on our pricing page. Invoices are due 30 days from issue unless otherwise agreed.

Where a payment is made by card, it is processed by our payment provider acting as merchant of record. We do not store card details: no card number, security code or expiry date is accepted, transmitted or stored by us at any point. Refunds and cancellation are covered by our Refund and Cancellation Policy.

Prices published on our pricing page are stated in US dollars and are exclusive of sales tax, VAT, GST and any similar tax or duty. Where payment is taken by card, our payment provider acts as merchant of record and is responsible for assessing, collecting and remitting the tax due on that sale, so the total charged to you will include it. Where we invoice you directly, any such tax is your responsibility unless the invoice states otherwise. Amounts are payable in US dollars unless we agree otherwise in writing.

If you dispute a charge, contact us first at billing@roamingproxy.com. We retain request logs as described in the Privacy Policy and will use them as evidence of delivered service in any payment dispute or chargeback.

5. Service levels and availability

The Service is provided without a contractual uptime guarantee. We do not currently offer an SLA with service credits. We perform maintenance that may cause brief interruptions and will give advance notice where practical. Any uptime or throughput figures shown in the dashboard are measurements, not commitments.

6. Your data and ours

You keep all rights in the content you send through the Service. You grant us only the licence needed to transmit, process, and store it in order to operate the Service and meet legal obligations.

We keep all rights in the Service itself, including our software, APIs, documentation, and the user-agent corpus. You may use the user-agent library in your own applications; you may not redistribute it as a standalone dataset or product.

7. Suspension, termination and deletion

You may close your account at any time from the dashboard. We may suspend or terminate an account for material breach of these terms, for non-payment after written notice, or if required by law.

On termination we delete your account data on the schedule set out in the Privacy Policy. Logs kept for abuse prevention, tax, and payment-dispute purposes survive account deletion for the retention periods stated there.

8. Warranties and liability

The Service is provided “as is” and “as available”. To the maximum extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data. Our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amounts you paid us in the three months before the event giving rise to the claim, or (b) one hundred US dollars.

Nothing here limits liability that cannot be limited by law, including for fraud, or for death or personal injury caused by negligence.

9. Indemnity

You will indemnify us against third-party claims arising from your use of the Service in breach of these terms, including claims that your traffic accessed a system without authorisation or infringed a third party's rights.

10. Changes to these terms

We may update these terms. For material changes we will email account holders at least 30 days before they take effect, and update the effective date above. Continuing to use the Service after that date means you accept the change. If you do not accept it, stop using the Service and close your account.

11. Governing law and disputes

These terms are governed by the laws of the State of New York, United States, excluding its conflict-of-laws rules. The state and federal courts located in New York County, New York have exclusive jurisdiction, and both parties consent to venue there. If you are a consumer, this does not deprive you of the protection of mandatory laws in your country of residence.
